The Massachusetts Collaborative Law Council (hereinafter, “MCLC”) provides www.massclc.org, www.masscollaborativepractice.org and any included sites and subdomains (hereinafter, the “Site”) as a service to the public and our members. Use of the Site is subject to the following Terms of Use. Use and viewing of the Site indicates acceptance of these terms, without modification.
The Content of the Site does not convey legal, accounting, tax, career or other professional advice of any kind. Use of the Site does not create an attorney-client or therapist-client relationship between you and MCLC or any of our members, nor will any information you submit to us via the Site or by electronic mail be considered a protected communication or otherwise be treated as confidential or privileged in the absence of pre-existing express agreement by us to the contrary.
The Content of the Site may be considered advertising for services of the members under the laws and rules of professional conduct of the jurisdictions in which our members practice.
The Content of the Site concerns topics selected by MCLC for dissemination to the general public, and is offered on a blind basis, without any knowledge as to your identity or specific circumstances. To the fullest extent permissible pursuant to applicable law, all warranties, express or implied are disclaimed, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The application and impact of relevant laws will vary from jurisdiction to jurisdiction. There may be delays, omissions or inaccuracies in information contained on the Site. You should not rely on or act upon any information or materials available through the Site without professional advice from a qualified professional.
The Content of the Site should not be relied upon or used as a substitute for consultation with professional advisers.
Under no circumstances shall MCLC be liable for any damages that result from the use of, or the inability to use, the Site or the information contained on the Site, even if MCLC has been informed of the possibility of such damages. In no event shall MCLC bear any liability for any damages losses, and causes of action whether in contract, tort (including, but not limited to, negligence) or otherwise that exceed $1.
The Site may include links to sites operated by third parties, or other web sites or web pages may link to the Site. These links are provided to you only as a convenience. MCLC does not monitor, filter, edit, or censor the materials or information appearing on these other web sites or web pages. Such linked sites are not under our control, and we are not responsible for the contents of any linked site, or any link contained in a linked site. The inclusion of any link does not imply endorsement by MCLC or any of our members.
This Agreement and any dispute arising out of or related to this Agreement or the use of the Site, as well as the terms and conditions set forth in this Agreement, shall be governed and interpreted pursuant to the laws of the Commonwealth of Massachusetts, United States of America, notwithstanding any principles of conflicts of law.
All disputes arising out of or relating to this Agreement, as well as the terms and conditions set forth in this Agreement shall be resolved by arbitration conducted in the English language in Boston, Massachusetts, U.S.A. under the commercial arbitration rules of the American Arbitration Association. The parties shall appoint as sole arbitrator a retired judge who presided in the Commonwealth of Massachusetts. The parties shall bear equally the cost of the arbitration (except that the prevailing party shall be entitled to an award of reasonable attorneys’ fees incurred in connection with the arbitration in such an amount as may be determined by the arbitrator). All decisions of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction. Notwithstanding this, application may be made to any court for a judicial acceptance of the award or order of enforcement. Notwithstanding the foregoing, the Firm shall be entitled to seek injunctive relief, security, or other equitable remedies from the United States District Court for the District of Massachusetts or any other court of competent jurisdiction.
If any part of these terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. MCLC may, at its sole discretion and without notice, revise these terms at any time by updating this posting.
By using the Site, you agree to indemnify, hold harmless and defend MCLC, its partners, employees and agents from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys’ fees, resulting directly or indirectly from a claim by a third party that alleges injury, damage or harm in whole or in part arising from the provision by you of information from, or claimed to be from, the Site, or that in any way arises from your use of the Site or information provided by the Site in violation of these terms.
MCLC may alter, suspend, or discontinue the Site at any time for any reason, without notice or cost. The Site may become unavailable due to maintenance or malfunction of computer equipment or other reasons.
Privacy Policy For Members And Registrants:
Any data MCLC collects is used only to help us better serve our members and the public. It is our general policy to collect and store only personal information that our members and visitors knowingly provide. MCLC does not collect any personal information from users browsing its website. Aggregate data may be collected by our hosting provide for statistical purposes and are only used for internal and marketing purposes and do not provide any personally identifying information.
To gain access to members-only resources and personalization features on the website, members and other users are asked to register and provide some limited information. This information is submitted voluntarily. MCLC only uses this information to enhance its products and services and distribution of those products and services to its members and the public. This information is not sold or distributed in any other manner. Generally, MCLC uses data collected to improve its own web content; to respond to visitors’ interests, needs and preferences; and to develop new products and services.
MCLC also makes member contact information available through the MCLC Membership Directory to the general public. Users may request that MCLC refrain from disclosing the data it collects to third parties on the membership application form or any other form on which they are providing information; an opt-out box appears on said application. Alternatively, users may contact MCLC to express their preferences if they determine later that they do not wish to have the information shared.
MCLC does not disclose credit card account information provided by its members and customers. When members and customers pay using their credit cards, MCLC submits the information needed to obtain payment to the appropriate clearinghouse, through Paypal.
