2015 Introductory Collaborative Training

In this step-by-step, interactive three-day training, attendees will learn the Collaborative Law approach to conflict resolution and how to incorporate this revolutionary process into their practice.  This program will be valuable to all professionals interested in transforming their dispute resolution practice, including attorneys, financial specialists, mental health professionals, and mediators.

What is Collaborative Law?

Collaborative Law is a structured, supportive process that helps parties reduce conflict and reach a fair resolution out of court.  A dispute resolution approach that offers an important and effective alternative to litigation, Collaborative Law practice is rooted in a “paradigm” shift away from a zero-sum, adversarial approach and towards an interests-based, facilitative process. Attorneys and other professionals work as part of an interdisciplinary team to engage clients as joint problem-solvers and help clients come to a reasoned resolution that meets the clients’ core needs.

The Collaborative Law process may be used to resolve conflict in all types of matters, including family, business, and probate disputes.   The team of professionals involved will vary depending on the type of matter.  In the family law model, for example, each client is represented by a Collaboratively-trained attorney, while a neutral mental health professional, or “coach,” facilitates the negotiations and manages the process and a neutral financial specialist provides economic projections and sophisticated tax analyses.  Other Collaboratively trained neutral specialists may be included where needed.  In business or probate disputes, the Collaborative team will be appropriately structured to provide clients with the information, guidance, and support necessary to negotiate mutually-beneficial outcomes.

Benefits of Attending

Participants will take away the robust basic skills necessary to begin handling matters Collaboratively, as well as tools they can implement to continue their development as Collaborative practitioners.  Participants also immediately become part of a growing, cutting-edge international community of Collaborative practitioners. This training meets the standards set forth by the International Academy of Collaborative Professionals (“IACP”), and those completing this training are eligible for membership in the Massachusetts Collaborative Law Council and the IACP.
