Topic:              Trusts Interests in Divorce

The presentation on trust interests in the divorce context will focus on whether the interest of a spouse in a trust is included within the marital estate and if so, how such an interest may be valued.  Jon will summarize the practical importance of significant cases, including Pfannenstiehl v. Pfannenstiehl (2016). Jon will also address trust income for support purposes, the extent of trustee discretion, and spendthrift clauses. There will be time for Q & A.

Jon is a litigator, Collaborative lawyer, and mediator. A fellow of the American Academy of Matrimonial Lawyers and past president of the Massachusetts Council on Family Mediation, Jon is a graduate of Amherst College and Boston University Law School. Jon describes his practice as 50% divorce mediation and 50% resolving divorces through negotiation, litigation, or a combination.
