It’s that time again! For many couples, the marital home and the disposition of this key asset is often one of the greatest challenges facing them as they work their way through the Collaborative Process. Ellen Klapper will be speaking with us about the mortgage lender’s view and the practical aspects of what happens to the marital home from the banking side perspective.  We hope you will join us for the Greater Boston Collaborative Law Practice Group on Tuesday, November 4 at Boston Law Collaborative (99 Summer St/Boston, MA 02110) between 12:30 and 2:00. Please bring a lunch as we will be serving refreshments only. Ellen will cover topics such as:

  • How the bank views the deed back into the name of only one spouse while both spouses are still on the mortgage
  • Whether a spouse is able to refinance in order to remove the spouse no longer on the deed from the mortgage
  • Why to use a 3rd party as co-guarantor
  • What the realistic timing of a refinance transaction is
  • What the differences are between removing a spouse’s name from a deed and from a mortgage  - and why to choose one over the other
  • What a portfolio lender/secondary market lender is and why a couple might want to use one versus the other
  • What the pros and cons of ARMs are for the divorcing couple
  • How the ever-changing world of mortgage rules and regulations affects the divorcing couple
  • Update on credit scores
  • Underwriting the self-employed borrower vs. the W-2 employee borrower
  • First-Time Homebuyers and Affordable Housing Programs
