Alimony Roundtable:  New Developments from the Courts

As cases interpreting the Alimony Reform Act of 2011 begin to make it to Massachusetts’s highest courts, what can we learn from these cases, and how do they impact our cases in the Collaborative Law process, as well as in our mediated and litigated cases? At this month’s meeting we will discuss the recent cases of Hassey, Zaleski, Holmes and Green, and see how they may help us answer the following questions:

 

  • In what circumstances is it appropriate for alimony to be paid after the obligor reaches Social Security retirement age?
  • Durational limits- does temporary alimony “count”?
  • When is rehabilitative alimony appropriate?
  • Has the Alimony Reform Law changed the purpose and/or definition of alimony?
  • Amount of alimony- is it need or 30 to 35% of the difference in the parties’ incomes?
  • Are self-modifying alimony orders appropriate?
  • What is the role of the marital lifestyle in determining need for alimony?
